Bridging the Constitutional Amendment
with Statutory Reform

The core of our reform proposal recognizes a critical need: to amend state statutes to complement the 2017 constitutional changes. This statutory adjustment is pivotal, enabling judges to once again set secured bonds, informed by a system that respects defendants' financial situations while upholding public safety. Our innovative solution—state-funded bond premiums—emerges as the key to unlocking this potential. By funding only the bond premiums, a fraction of the total bond amount, we enable a financially prudent model that leverages the bail bond system's accountability and efficiency.

The Core of Our Reform: Enhancing Public Safety and Judicial Efficiency

Our current bail system, with its noble intent to protect the financially disadvantaged, has led to a situation where defendants, once released, have little incentive to reappear for court hearings. This gap in accountability has a direct impact on public safety:

  • Lack of Immediate Pursuit: When defendants choose not to attend their court hearings, there isn't always an active effort to locate and bring them back. This oversight allows them the freedom to potentially engage in further criminal activities, endangering public safety.

  • The Role of Bail Bondsmen: Contrastingly, the involvement of bail bondsmen changes the landscape significantly. Bail bondsmen not only guarantee a defendant's court appearance but also assume the responsibility to actively seek out defendants who decide against appearing in court. This proactive approach significantly deters further criminal activity by ensuring defendants are promptly brought to justice.

The existing system, therefore, by allowing defendants to remain largely unsearched for, inadvertently prolongs the period during which they can commit further crimes. The introduction of a bond system aims to mitigate these risks by shortening the timeframe within which defendants can operate freely without facing justice.

Addressing the Financial Logic Behind the Proposed Reform

One of the most compelling aspects of our proposed reform is its financial efficiency and logic:

  • State-Supported Bond Premiums: We propose that the state fund only the bond premiums, which constitute a fraction (typically 10%) of the total bond amount. This approach leverages the efficiency and vigilance of the bail bond system at a minimal cost to the state and taxpayers.

  • Financial Recourse: In cases where defendants fail to appear, the bail bond companies, backed by financial institutions, are obligated to cover the majority of the bond's value. This ensures that the state's investment is protected and that there is a strong financial incentive for bail bondsmen to ensure defendants' appearances in court.

  • Cost-Effectiveness: Compared to the current pre-trial services, which incur costs with variable outcomes in ensuring defendants' court appearances, the proposed system offers a more reliable and financially sound alternative. By funding bond premiums, we invest in a mechanism that not only enhances public safety but also assures financial prudence, given the bail bond system's accountability and track record.
